Our point of dispute lies in the gross negligence, robbery and deceit committed by the company and movers.
In summary:
-broke $2500 TV and $100 lamp, that Nicola told us we could not individually insure, then forced us to sign with threats of charging us more, if we wouldn't sign 30cents/pd. They packed both of these, in their own boxes
-stole my ipod, and brand new clothes (see more below).
-we saw Gerard callously break our big mirror that attaches to a desk. He picked it up not by the base, but a wooden 2" by 4" attachment board, which would obviously not hold the weight of this heavy mirror. He promised that the company has two repair men that could come fix it, which as per the company, he lied. No one came to fix it.
-Also broke lots of wine glasses and dishes.
-Bad indentations and scratches on ALL of our bedroom set. Gerard said someone would come fix this, to no avail.
- We received someone else's decorations. Who know what is missing from our stuff that we do not realize.
-Without permission, they packed away my work uniform even though I explicitly told them not to touch a certain pile (which also had my stolen ipod and clothes, several times.
-Lots of hidden charges that you will find out along the way. Only one example, no one told us that they charge us for the time to put into storage.
-4 Roaches and waterbugs (both dead and alive) in the boxes. Also mice droppings (I was an exterminator for 15 years).
-Very rude and disparaging, mainly Margaret Lombardi, from claims. She is extremely condescending and not the least sympathetic. My wife did not fell comfortable speaking to her.
-Inconvenience. Because the TV was broken, I still have no internet or phone service because Time Warner will not come until you have a TV. I am a radiologist and had been on call 3 times since this occurred and I really need internet and phone.
-Shleppers uses delay tactics and try to wear you out. They hope that the customer will just take what is offered. They make false promises. After we complained to customer service about claims, they said they would be able to give us much more than the 311.50. They did not.
MAIN ISSUE
They broke a 2500 plasma TV and 100 dollar lamp and stole my ipod and new, tagged clothes (more on this below). THEY packed/unpacked the TV and lamp in THEIR own boxes. Since the first sales representative Nicola told us they we could NOT insure individual, more valuable boxes like we would have wanted (The company will lie and say she would not have said this and also argue that she is not qualified to let us know about the insurance, which should not up to the customer's discretion to determiner if a Sales Rep is qualified or not). Therefore, we did not further inquire into extra insurance, which we would have liked for certain boxes. She should have told us that she did not know about the insurance or you have to call, but she did not.
Then they forced us to sign 30cents/pounds, even after or they would not leave and keep on charging us the hourly rate. Where we signed, it says "Unless the shipper expressly releases the shipment to a value of 30 ( ) cents per pound per article, the carrier's maximum liability for loss and damage shall be either the lump sum value declared by the shipper of 2500, whichever is greater".
When I asked the company about this statement, they try to twist it and make it more confusing and wordy then it need to be. This is meant to seem that you may get up to $2500. Gerard, the foreman who forced us to sign, probably lied or at least not knowingly told us that we could get more than the 30cents/pd, and closer to the 2500 that is stated above. We tried calling the company before we signed for some clarity and assurance but no one was conveniently there to pick up the phone. We were forced into signing and promised this we would be worked out later on. It was not at all as well were only promised about 311.50 (as we found out several weeks later). No one in their right mind would sign something valuing at 30 cents per pound after they see their 2500 TV is broken. There was duress. It is a contract of adhesion, and thus should be unenforceable (especially since we were initially told by Nicola that we could individually insure each box!). We should have not signed, and that is where I blame us. That is when we called American Express to cancel the payment, but since it was already pending, we were not able to do so until the charge went through. We also think that Gerard, may have done it on purpose as the team was mad because we could not let them move in earlier and it was a weekend. It was obvious that the team wanted to leave asap. By the way we still tipped them 15% and the first team 20%.
We moved on late June and moved in late July. We put our stuff in Shlepper's storage while we were on vacation. I had in a neat pile my ipod and new clothes (many of which the tags were still on), which were suppose to go away with me. I told Carlo's team (Carlo was the foreman on the first move), NOT to touch this pile several times. They still tried to pack it, even though, I told them not to. This is when they stole my ipod and new clothes. The only reason that I did not report that then was because I wanted to be 100% sure that they did not pack it away "accidently", since they were snooping in that pile all day.
